These Terms of Service ("Terms") govern your use of www.unclestumpgrinding.com (the "Website") and your interactions with Uncle Stump, LLC ("Uncle Stump," "we," "us," or "our").

By accessing or using the Website, requesting a quote, or communicating with us through the Website, you agree to these Terms.

These Website Terms are intended to govern your use of the Website and general interactions with Uncle Stump. A separate written estimate, proposal, work authorization, or service agreement may contain additional terms that apply to a specific job.

1. Our Services

Uncle Stump provides stump grinding and related services, including stump grinding, mulch removal, surface root grinding, and related property services.

Our service area generally includes communities throughout the Treasure Valley, including Boise, Meridian, Eagle, Star, Kuna, Nampa, and Caldwell.

Specific services, pricing, availability, and job requirements are determined on a project-by-project basis.

2. Quotes and Estimates

Requests submitted through the Website do not automatically create a contract for services.

Quotes and estimates are based on information available to us at the time of the estimate, including the size and condition of the stump, access to the property, surrounding structures and landscaping, root systems, and other observable site conditions.

An estimate may be revised if material site conditions differ from the information available when the estimate was prepared or if the requested scope of work changes.

A service agreement, written estimate, work authorization, or other written confirmation may establish the final scope of work and price for a particular project.

3. Property Access and Customer Responsibilities

Before work begins, you are responsible for providing Uncle Stump with reasonable access to the area where work will be performed.

You agree to:

  • Provide accurate information about the property and requested work.

  • Identify known underground utilities, irrigation systems, septic systems, drainage systems, or other buried structures or obstacles.

  • Obtain any permissions, approvals, or property-owner consent necessary for the requested work.

  • Remove or secure personal property and other items near the work area when reasonably requested.

  • Keep children, pets, and unauthorized persons away from the work area while work is being performed.

  • Provide safe and reasonable access to the work area.

You should inform us of any known hazards or conditions that could affect the work before work begins.

4. Underground Utilities and Hidden Conditions

Stump grinding can involve underground roots, irrigation systems, utility lines, pipes, cables, and other concealed conditions.

Uncle Stump will take reasonable precautions based on information available to us and may request utility locating or other precautions when appropriate.

However, underground conditions may not always be visible or known in advance. Customers are responsible for identifying and disclosing known private utilities, irrigation lines, sprinkler systems, septic components, landscape lighting, drainage systems, and other privately installed underground features that may not be identified through ordinary utility locating services.

Uncle Stump is not responsible for damage to concealed or undisclosed underground features to the extent permitted by applicable law.

5. Property and Landscaping Conditions

Stump grinding involves heavy equipment, grinding operations, wood chips, soil disturbance, and movement across or near lawns, landscaping, driveways, fences, and other property.

While we take reasonable precautions to minimize damage, some disturbance may occur as a normal consequence of stump grinding.

Existing conditions such as weak soil, buried objects, roots, rocks, uneven terrain, landscaping, irrigation systems, or concealed structures may affect the work area.

6. Scope of Work

The scope of work for each project will be based on the applicable estimate, proposal, work authorization, or agreement.

Unless specifically included in writing, stump grinding does not necessarily include:

  • Removal of all roots

  • Removal of every piece of wood or root below the grinding depth

  • Replacement of grass, sod, plants, landscaping, or hardscaping

  • Repair or replacement of irrigation systems

  • Repair of underground utilities

  • Removal of unrelated debris

  • Hauling away of mulch or wood chips

Mulch removal or other additional services may be available when specifically requested and included in the agreed scope of work.

7. Grinding Depth and Results

Uncle Stump commonly grinds stumps approximately 6–12 inches below ground level, depending on site conditions, equipment access, the stump, and the agreed scope of work.

Actual results may vary based on soil conditions, root structure, rocks, utilities, access, and other conditions at the property.

Stump grinding does not guarantee that a tree or stump will never produce additional growth. Certain species may produce shoots or regrowth from remaining roots.

8. Scheduling and Weather

Scheduled service dates are subject to weather, equipment availability, site conditions, emergencies, and other circumstances beyond our reasonable control.

We may reschedule work when conditions make performing the work unsafe or impractical.

We will make reasonable efforts to communicate material scheduling changes.

9. Payment

Payment terms will be communicated in the applicable estimate, invoice, or service agreement.

Unless otherwise agreed, payment is due upon completion of the services.

We may accept payment by card, cash, invoice, or other payment methods made available by Uncle Stump.

Customers are responsible for applicable taxes, fees, or other charges disclosed before or at the time of payment.

10. Cancellations

If you need to cancel or reschedule a service, please contact Uncle Stump as soon as reasonably possible.

Any cancellation fees or other charges will apply only if disclosed in the applicable estimate, service agreement, or other written agreement.

11. Customer Satisfaction and Service Issues

We strive to provide professional, careful, and satisfactory service.

If you believe there is an issue with completed work, please contact us promptly so that we have an opportunity to review the situation and, where appropriate, determine a reasonable solution.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be waived under applicable law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Uncle Stump will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the Website or services, including loss of use, loss of income, or other consequential losses.

To the extent permitted by applicable law, Uncle Stump's total liability arising from a particular service will not exceed the amount actually paid to Uncle Stump for the specific service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. Website Use

You agree not to:

  • Use the Website for unlawful purposes.

  • Attempt to interfere with the operation or security of the Website.

  • Introduce malicious software, code, or other harmful material.

  • Attempt to gain unauthorized access to the Website or its systems.

  • Use automated methods to scrape or collect information from the Website in a manner that interferes with its operation.

  • Submit false, fraudulent, or misleading information.

We reserve the right to restrict or terminate access to the Website when reasonably necessary to protect the Website, our business, or other users.

These Terms will be governed by and interpreted under the laws of the State of Idaho, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Any dispute arising from these Terms or the use of the Website will be subject to the jurisdiction of courts located in Idaho, unless otherwise required by applicable law.

We may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

20. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

These Terms constitute the general terms governing use of the Website. For actual services, the applicable written estimate, proposal, work authorization, invoice, or service agreement may contain additional or different terms that control the specific project.
